Terms of Service

These Terms of Service (“Terms”) govern your use of BalanceJournal (“BalanceJournal”, “we”, “us” or “our”), a free wellness app available on the web and on iOS and Android. Please read them carefully before using the service.

1. Acceptance of these terms

By creating an account or otherwise using BalanceJournal, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the service. You must be at least 18 years old to use BalanceJournal.

2. The service

BalanceJournal is a free wellness application that lets you track your mood, build habits, manage tasks and goals, and keep a personal journal. It also offers an optional AI summary feature that processes the text of a journal entry through a third-party AI provider only when you choose to use it. We may add, change or remove features over time, and we may offer the service on a free basis without any guarantee of continued availability.

3. Your account and responsibilities

  • You are responsible for the accuracy of the information you provide when registering.
  • You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
  • You are responsible for the content you create in the app and for ensuring you have the right to store and process it.
  • Notify us promptly at contact@balancejournal.app if you believe your account has been compromised.

4. Acceptable use

You agree not to:

  • Use the service for any unlawful, harmful or fraudulent purpose;
  • Attempt to gain unauthorised access to the service, other accounts or our systems;
  • Interfere with, disrupt, overload, reverse engineer or attempt to circumvent the security of the service;
  • Upload malicious code, or content that infringes the rights of others;
  • Use the service to harass, abuse or harm another person.

We may suspend or terminate accounts that violate these Terms or that pose a risk to the service or other users.

5. Your content

You retain ownership of the content you create in BalanceJournal (your journal entries, mood records, metrics, tasks and goals). You grant us only the limited permission needed to store, process and display that content so we can provide the service to you. We do not sell your content, and we handle it as described in our Privacy Policy.

6. Intellectual property

BalanceJournal and all of its software, design, branding, logos and content (other than your own content) are owned by us or our licensors and are protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or intellectual property except as necessary to use the service as intended.

7. Health disclaimer

BalanceJournal is a self-reflection and wellbeing tool. It is not a medical device, and it does not provide medical, psychological, or therapeutic advice, diagnosis or treatment. The app — including any AI summaries or insights — is for informational and self-tracking purposes only and is not a substitute for professional medical advice, therapy or care.

Always seek the advice of a qualified health professional with any questions about your mental or physical health. Never disregard or delay seeking professional advice because of something you read in the app. If you are in crisis or may be a danger to yourself or others, contact your local emergency services or a crisis helpline immediately.

8. Third-party services

The service relies on third-party providers — for example for AI summaries, email delivery, push notifications and analytics — as described in our Privacy Policy. We are not responsible for the practices of those third parties, and their use may be subject to their own terms.

9. Disclaimer of warranties

The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error-free or that any content (including AI-generated content) will be accurate or reliable.

10. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special or consequential damages, or for any loss of data, arising out of or in connection with your use of — or inability to use — the service. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including your statutory rights as a consumer.

11. Termination

You may stop using the service and delete your account at any time in the app via Settings → Delete account, which permanently removes your data as described in the Privacy Policy. We may suspend or terminate your access if you breach these Terms or if we discontinue the service.

12. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app or by email. Continued use of BalanceJournal after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Poland and applicable European Union law, without regard to conflict-of-law rules. Mandatory consumer-protection rights available to you in your country of residence remain unaffected.
